Open Sense Solutions LLC warrants that Groovix Computers are free from
defects in materials or workmanship under normal use during the
warranty period. The warranty period commences on the date of purchase.
The warranty does not cover:
- Shipping costs from the user to Open Sense Solutions.
- Any problems with or caused by hardware that
has been added (that did not come with the system).
- Any files or data that have been deleted or
lost by any means.
- Any consumables.
- The warranty does not include liability for
data loss due to defective hardware.

Data backup is the
responsibility of the user and YOU should ensure your data is backed up
at all times.
>The following services are specifically
excluded from coverage under the Warranty, and if such services are
performed, shall be charged (labor, parts, and travel related expenses)
to you at Open Sense Solutions LLC prevailing prices and hourly rates
(portal to portal) with a minimum charge of one (1) hour per call:
- Maintenance of accessories, attachments, or
other devices not under warranty by Open Sense Solutions LLC. This
includes accessories and add-ons purchased from Open Sense Solutions
LLC that have a manufacturer's warranty.
- Owner's requested specifications changes or
services connected with relocation of the Equipment.
- Preventive maintenance, routine cleaning, or
lubrication and set-up.
- The repair and replacement of consumables such
as but not limited to: magnetic diskettes, tapes, batteries,
cartridges, ribbons, print heads, toner cartridges, drums, and
developer units.
- Services performed outside Open Sense Solutions
LLC normal hours or Standby Time. Standby Time is time spent at the
site awaiting access to the Equipment.
- Inspection or testing by Open Sense Solutions
LLC resulting in "no problem found." (Open Sense Solutions LLC may
charge you for this service.)
- Repair, maintenance, and adjustment to the Equipment for reasons other
than ordinary wear and tear, including, but not limited to, your or
other user negligence, neglect, misuse (including faulty installation,
repair, or maintenance by parties other than Open Sense Solutions LLC
or it's representative), abuse, misapplication, accident, or
modification without Open Sense Solutions LLC prior written approval,
use of supplies or software which are defective or do not meet Open
Sense Solutions LLC specifications, use with other devices not covered
under this Warranty, improper environment (including lack of proper
temperature or humidity control), unusual physical or electrical stress
or interference, failure or fluctuation of electrical power, air
conditioning, or sprinkler system, lightning, static electricity, fire,
storm, relocation or reinstallation of the Equipment by anyone other
than Open Sense Solutions LLC or it's representative, vandalism, water
damage, other casualty beyond the control of Open Sense Solutions LLC
or it's representative, acts of God, or damage ordinarily covered by
insurance.
- Service necessary to comply with requirements
or regulations of any governmental body or agency arising after this
Agreement, or if the serial numbers or other means of identification of
the Equipment have been tampered with or removed.
- Open Sense Solutions LLC shall not be required
to perform maintenance service to Equipment if attachments to or
alterations of such Equipment makes such maintenance impractical or a
safety hazard.
- Network administration (adding users, etc) and
tuning (writing script files, etc) are not covered by this agreement,
and will be billed at the current hourly rate when required.
Open Sense Solutions LLC, at their sole discretion, may replace the
Equipment in whole or in part with comparable equipment and may use
remanufactured and refurbished parts and modules in performing service.
Replacement parts and modules shall become your property; the replaced
parts shall become the property of Open Sense Solutions LLC and shall
be returned to Open Sense Solutions LLC at Owner's expense.
Any replaced parts are warranted for a period of time up to the
remainder of the time left on the original Equipment warranty.
Open Sense Solutions LLC LIABILITY UNDER THIS AGREEMENT SHALL BE
LIMITED TO KEEPING THE EQUIPMENT IN GOOD WORKING ORDER. YOU HEREBY
AGREE THAT Open Sense Solutions LLC SHALL NOT HAVE ANY LIABILITY
WHATSOEVER WITH RESPECT TO ITS OBLIGATIONS UNDER THIS AGREEMENT FOR ANY
CONSEQUENTIAL, EXEMPLARY, SPECIAL, INDIRECT OR INCIDENTAL DAMAGES. Open
Sense Solutions LLC SHALL NOT BE LIABLE FOR ANY DAMAGES CAUSED BY A
DELAY IN THE FURNISHING OF MAINTENANCE SERVICES UNDER THIS AGREEMENT
EVEN WHEN INFORMED IN ADVANCE OF THE LIKELIHOOD OF SUCH DAMAGE.
NEITHER Open Sense Solutions LLC, NOR ITS AFFILIATES, PARTNERS, AGENTS,
SUPPLIERS, OR REPRESENTATIVES WARRANT THAT YOUR COMPUTER HARDWARE OR
SOFTWARE WILL MEET MINIMUM PERFORMANCE LEVELS OR THAT THE HARDWARE OR
SOFTWARE PROVIDED TO ME BY Open Sense Solutions LLC WILL BE FREE FROM
DEFECTS OF ANY KIND OR WILL PERFORM IN ACCORDANCE WITH THEIR
SPECIFICATIONS; NOR DO THEY MAKE ANY WARRANTY AS TO THE RESULTS THAT
MAY BE OBTAINED THROUGH MY USE OF THE FOREGOING. Open Sense Solutions
LLC may, at its discretion, engage subcontractors to perform work
hereunder, provided Open Sense Solutions LLC shall fully pay said
subcontractor and in all instances remain responsible for the proper
completion of this Warranty.
All change orders shall be in writing and signed both by Owner and Open
Sense Solutions LLC.
In the event Owner shall fail to pay any payment due, Open Sense
Solutions LLC may cease work without breach pending payment or
resolution of any dispute.
OTHER GENERAL PROVISIONS.
In the event that any one or more of the provisions contained in this
Warranty shall for any reason be held to be invalid, illegal or
unenforceable in any respect, this Warranty shall be enforced to the
maximum extent possible.
No waiver of any provision of the Warranty by Open Sense Solutions LLC
shall be deemed to be an ongoing waiver of such provision or rights of
Open Sense Solutions LLC related thereto.
Except as otherwise specified herein, any notice to be given under the
terms of this Warranty shall be in writing and shall be posted in plain
view at Open Sense Solutions LLC specified address.

A one year subscription to Groovix Software Updates is included with
new system purchases and gives the user access to the Groovix tested
software repository. Groovix Software updates include security
fixes, bug fixes, and feature updates. When you renew your
Groovix Software Update subscription, you will also be sent an updated
Groovix Restore DVD.
A Groovix Software Update subscription also includes Groovix
Standard Support.

Standard Support for Groovix systems is included with a subscription to
software Updates.
Standard Support includes e-mail support for problems encountered using
Groovix Recommended Hardware and Software.
Standard Support does NOT include:
- support for answering questions on how to
operate a particular software program
- support for hardware or software that has been
re-configured differently than the default setitngs
- support for recovering data that was lost by
any means

Comprehensive Support from Open Sense Solutions LLC gives the user
e-mail and phone technical support for any issue. Comprehensive
Groovix support currently costs $99/year and provides help for up to 10
incidents and a maximum of 2 hours total support. At $50/hour, that is
only half of the industry standard $100/hour support cost! If you have
questions on how to accomplish certain tasks or need help installing
third-party hardware or software, the Comprehensive Support option has
you covered.

This
privacy policy is effective as of November 30th, 2004.
Information Collection
and Use
Open Sense Solutions LLC
is the sole owner of information collected on this site. We will not
sell, share, or rent this information to any outside parties, except as
outlined in this policy. We collect information from our customers to
process orders and better serve you with pertinent information, such as
order confirmations and order status updates. Information collected
includes your name, shipping address, billing address, telephone
numbers, e-mail address, and payment information such as your credit
card number. We also require you to submit a username and password of
your choice for your future access to your account information. To
safeguard that your user name and password remain confidential, DO NOT
share this information with anyone. If you elect to receive our
newsletter or special promotions, your contact information will be used
for the delivery of these items.
Registration
In
order to process your orders placed on this website, you must first
complete the registration form. During registration, you will be
required to provide your contact information, which includes your name,
e-mail address, telephone number and street address. This information
is used to provide you with important Open Sense Solutions LLC services
such as
automated order status updates via e-mail.
Order
Most
of the information collected in the registration process will be used
to process orders. During the order process, you will have to provide
financial information such as your credit card number, expiration date,
money order, wire transfer or check information. This information is
used for billing purposes and to fulfill your order. If we have trouble
processing an order, we will use this contact information to get in
touch with you. To properly process your credit card information, we
must share your personal and financial information with the merchant
bank for authorization and approval. This process is protected by an
enhanced security system. See the Security section below for more
details on security measures and procedures. We do not share your
personal and financial information with any third parties, except those
specified in the Sharing section of this policy.

Correction/Updating/Reviewing
Personal Information
Customers

address or e-mail address through our website. You must have your
username and password in order to access
your account. In the event you forget both your username and password,
please contact our customer service department for assistance.
Choice/Opt-out
For
customers who wish to opt-out and stop receiving Open Sense Solutions
LLC special
offers and related news, Open Sense Solutions LLC provides several ways
to do so.
Users who no longer wish to receive our newsletter or promotional
materials may opt-out of receiving these communications by un-checking
the "permission to send" field when processing their orders. They may
also use the link provided
in all Open Sense Solutions LLC communications to automatically
unsubscribe.
Notification of Changes
If
at any point we decide to use personally identifiable information in a
manner different from that stated at the time it was collected, we will
notify users by way of an e-mail. Users can then choose to allow or to
not allow Open Sense Solutions LLC to use their information in this
different manner.
Unless Open Sense Solutions LLC provides a notification of this kind
and receives
your permission, Open Sense Solutions LLC will only use information in
accordance
with the privacy policy under which the information was collected.

Standard UPS shipping time is between 1 to 6 Business Days within the US and Canada. If we have all ordered items in stock your order will usually ship within 2 business days. All prices listed on our site do not include shipping, and in no circumstances will shipping costs be refunded.

SATISFACTION GUARANTEE
Open Sense Solutions LLC offers our customers a 30-day satisfaction replacement or refund guarantee on all Groovix computers and software.
However, to take advantage of Open Sense Solutions LLC's return guarantee policy, Customer agrees to comply with Open Sense Solutions LLC's Product Return Procedure as below. Any breach of Open Sense Solutions LLC's Return Policy Procedure will result in the loss of Open Sense Solutions LLC's replacement/return guarantee. Furthermore, all return shipments not in compliance with these instructions will be rejected.
Product Return Procedure
- To return a product based upon Open Sense Solutions LLC's replacement/return guarantee, you must obtain a Return Merchandise Authorization ("RMA") number within the guarantee return period for the product (described above). Please contact Open Sense Solutions customer support to acquire an RMA number. Open Sense Solutions LLC will not accept returns without prior authorization and a RMA number. Once issued, RMA numbers are valid for 15 days within which return products must be received by Open Sense Solutions LLC. RMA numbers will not be extended or reissued. Customer should prominently display the RMA number(s) on the shipping label of boxes containing the returned product.
- Customer is solely responsible for shipping any returned product to Open Sense Solutions LLC. Customer agrees to use only reputable carriers capable of providing proof of delivery and insurance for the entire value of the shipment. Customer agrees to bear all shipping charges and all risk of loss for the return product during shipment. Customer agrees that all returned products will be 100% complete, in re-saleable condition, and will include the original packaging material, manuals, blank warranty cards, and other accessories provided by the manufacturer. If any component of the returned product is missing, Open Sense Solutions LLC's Return Procedure will be breached and Open Sense Solutions LLC will reject the entire return or may choose to impose additional charges against the customer for replacement of the missing component.
- Open Sense Solutions LLC will not refund to Customer the original shipping charges.
